KAMPALA – Brian Isiko a 25-year old student at YMCA Jinja branch will have no more sleepless nights after court today (February 3) dismissed the cyber harassment case when allegedly he sent sent love messages to the Kabarole Woman MP Sylvia Rwabwogo.

Buganda Road Grade One Magistrate Ms Stellah Amabilisi has dismissed the cyber harassment and offensive communication case against Isiko saying that the case has been in court since 2018 and Ms Rwabwogo has failed to turn up for cross examination yet the accused keeps reporting.

“This clearly shows that the witness (Rwabwogo) is no longer interested in the case, in the interest of justice it will not be fair to keep the accused reporting to court. This case is dismissed and the accused should be refunded his bail money,” Ms Amabilisi ruled.

In June 2018 ; Isiko was sentenced to a 2years imprisonment term upon his own plea of guilty at Luzira prison after then Buganda Road court grade one magistrate Gladys Kamasanyu convicted him of sexually harassing MP Rwaboogo by sending her text messages containing phrases of lyrics he picked from love songs of legends such as Don Williams, Kelly Rogers and Enrique Iglesias.

However, through his lawyer Ramathan Waiswa, Isiko appealed to the Highcourt and managed to set aside the sentence but justice Jane Frances Abodo sent him back for a retrial before another magistrate.

Isiko who says he is now due for graduation has however not intimated if he will too sue the legislator for malicious prosecution.

The prosecution had stated that between the months of November 2017 and June 2018, Isiko used a computer to make love requests, suggestions or proposals which were obscene, rude, lustful or indecent to the person of Ms Rwabwogo.
It was further stated that Isiko willfully and repeatedly used electronic communication through SMS messages or attempted to disturb the peace and quiet enjoyment or right to privacy of Ms Rwabwogo with no purpose of legitimate communication.
