Father handed 15-year jail term for defiling daughter

KAMPALA– A father is to spend 15 years in coolers after the court finding him guilty of defiling his 13-year biological daughter.

High Court judge Alex Ajiji sentenced 40- year Musa Lutaya  to 15 yrs in prison upon his own plea of guilty to the offence of aggravated defilement.

“Although Lutaya has not wasted court’s time and resources by pleading guilty, he deserves a deterrent sentence to deter other fathers from defiling their daughters. Lutaya was supposed to protect his daughter from criminals but instead he decided to defile her,” justice Ajiji ruled.

The victim whose names are withheld because she is a minor said, her father first forced her to drink Empire for making her weak and after he performed sexual intercourse with her.

Prosecution states that the offence was committed during the month February 2015 at Kito zone Matugga in Wakiso district.

In the same court a 27year old man has also been sentenced to 17 years in prison after pleading guilty to defiling his sister’s 9 old daughter and infected her with HIV/AIDS.

Justice  Ajijia sentenced David Kayondo a resident of Nakulabye Hozana zone Rubaga division in Kampala upon his own plea of guilty to the offence of aggravated defilement thus asking for a lenient punishment.

Court heard that Kayondo used to defile his sister’s daughter whenever she was away for work.

Prosecution led by Ms Gladys Nyanzi states that the convict defiled the girl several times in the month of May 2015 well knowing that he was HIV positive.

According to the victim, her uncle warned her not to tell anyone and promised to harm her if she reveals the same.

Court documents indicate that on June 25,  2015, due to a lot of pain the victim revealed the incident to a neighbor who also revealed the information to the victim’s mother hence his arrest and prosecution.
