His detention is illegal! Court orders police to unconditionally release Bobi Wine’s bodyguard

Police has on Monday been ordered by court to release Eddie Mutwe, a detained bodyguard to Kyadondo East MP, Kyagulanyi Ssentamu alias Bobi Wine. (FILE PHOTO)

KAMPALA- High court judge, Musa Sekaana has ordered police to unconditionally release the bodyguard of Kyaddondo East MP, Hon. Robert Kyagulanyi alias Bobi Wine.

This is the second time the same court issues out such an order, where court had asked the army to either present the detainee Eddie Mutwe in any competent court of law or to release him unconditionally.

Justice Sekaana made the order after Eddie Mutwe through his lawyer Mr Eron Kiiza who appeared in court on Monday in the absence of the Attorney General of Government, the CDF and the Director Chieftaincy of Military Intelligence seeking for an order of his unconditional release.

Mr Kiiza submitted that since September 4, 2018 when the Attorney General’s representative Mr Peter Tusuubira informed court that they were charging Sebuufu with treason before Gulu Magistrate court, nothing has been done until now.

“That the applicant being in continued illegal police detention, the court in exercise of its discretionary power pursuant to Rule 6 of judicature (Habeas Corpus) Rules S1 13-6, orders D/SCP Womanya Elly or any other officers in whose custody the applicant is detained to immediately and unconditionally release him,” Justice Sekaana ruled.

Last month Mr Kiiza filed an application indicating that the family of Eddie Mutwe did not know his whereabouts, since his arrest on August 25 from Kamwokya Ssemakokiro Plaza in Kampala.

Kiiza maintained that Eddie was picked by the Military’s Special Forces Command Soldiers on the fateful day and taken to Mbuya, so he wanted the Attorney General of Government, the CDF and the Director Chieftaincy of Military Intelligence to ensure that Eddie Mutwe is produced in court if he committed any crime.

Mr Kiiza also sued the CID boss Ms Grace Akullo for the alleged continued illegal detention of Sebuufu.

Also sued alongside with Ms Akullo are; D/SCP Elly Womanya, the officer-in-charge of criminal investigations at CID Kibuli, SP Eliao Moses, the DPC of Jinja Road Station, and the Attorney General.
