
KAMPALA – The High Court has ruled that police’s blocking of Robert Kyagulanyi’s music show dubbed ‘Kyarega Extra’ was unlawful.
Kyagulanyi aka Bobi Wine set to perform at his One Love Beach at Busabaala on Easter Monday of last year but police blocked the show, citing failure to fulfill different requirements under the Public Order Management Act.
But on Wednesday, May 13, Justice Esta Nambayo said that the police was out of order to block the shows.
“I have already established that the actions of AIGP (Mr Asuman Mugenyi) were ultra vires, in the result, I will allow the application with the following declarations and orders; the decision making process and the decision itself of the 1st respondent (IGP) communicated to the applicants on April 19, 2019, indefinitely stopping them from organising the kyarenga extra concerts at One Love Beach- Busabaala, Lira, Gulu, Arua are illegal, irregular and in abuse of the 1st respondent’s powers,” ruled Justice Nambayo.
She also barred the police from further interfering with musical shows, organised by the two event promoters; Abby Musinguzi aka Abitex and Bajjo Events and marketing.
“An order of prohibition is hereby, issued restraining the respondents (IGP and AG) from assuming powers to authorize or sanction the holding of musical shows and celebrations of a social nature by the applicants (Abitex and Bajjo).”
The police was also ordered to meet the legal costs that the two musical and event promoters had spent pursuing this matter.
Abitex and Bajjo dragged the police to court after blocking Bobi Wine from accessing One Love Beach even when they had notified the Force about the concert.
