State withdraws application seeking to have new evidence against Kabarore Woman MP’s stalker

KAMPALA – Senior state attorney Ms Nelly Asiiku has withdrawn their application that was seeking to bring new additional evidence against a student Brain Isiko 25, who is facing charges of stalking Kabarore Woman MP, Sylvia Rwaboogo.

Mr. Isiko had been sentenced to 2 years and 9 months in prison by Buganda Road Magistrate Ms Gladys Kamasanyu after confessing his too much love to the legislator, Ms Sylvia Rwabwogo. However, this decision was quashed and High Court judge Jane Francis Abodo ordered for his retrial.

However, when the application came up for hearing Tuesday 19 before Justice Abodo, Ms Asiiku instead applied for the file to be sent back to lower court for hearing.

“This application was brought in error when court was ordering for retrial, there were specific orders of deadline which have authorities governing them. Court is bound by these authorities so we do not seek to go out of them,” Ms Asiiku told court.

Adding: “We just need to go back and conduct a retrial just as it is.”

Mr. Ramathan Waiswa the lawyer of Isiko also told court that an order cannot be revised for as long as the final decision is not yet out.

Justice Abodo has adjourned the matter to March 25 as to when she will give her detailed ruling.

Isiko a student at YMCA Jinja branch is facing charges of cyber harassment and offensive communication.
