Court denies dismissal of terrorism case against Kaweesi murder suspects

KAMPALA– Nakawa Court magistrate Noah Sajjabi has declined to dismiss a charge of terrorism against five people charged with the murder of the former police spokesperson Andrew Felix Kaweesi and his bodyguard.

The group, through their lawyer Anthony Wameli had asked court to dismiss their charges citing that the state had failed to bring evidence against them.

The five suspects who include; Ahmed Senfuka, Umar Maganda, Ali Mugoya, Hibwagi Sinani, and Abdul Kaala are accused of terrorism charges that the DPP says were committed between the years 2006  and 2007 in various places within Uganda and DR Congo.

However, the trial magistrate Sajjabi ruled that he could not dismiss the case because of its nature and adjourned the case to January 10.

It is alleged that the group and others still at large confessed to being part of a terrorist group Allied Democratic Forces (ADF) listed in the second schedule to the Anti-Terrorism Act 2002 between 2006 and 2007 while operating in various places within Uganda and DR Congo.

The five are also among the 20 accused of murdering Kaweesi and had sought for its dismissal or have it forwarded to the Constitutional Court.

Sajjabi informed the accused that the main file is still in the High Court Criminal Division for purposes of the bail application.

Prosecution alleges that the group between January and March 2017 in diverse districts of Kampala, Wakiso, Mukono, Jinja, Iganga, Bugiri, Busia, Tororo, and others at large for purposes of influencing government involved themselves in the complicity of the murder of Kaweesi.

It further alleged that the accused rendered support to Balyejusa and Ogutu, who are members of the Allied Democratic Forces (ADF), rebel group in executing terrorism Acts.

However, their colleague Abdul-Rashid Mbaziira, Aramanzani Noordin Higenyi alias Taata Abdullazack, Yusuf Mugerwa alias Wilson, Bruhan Balyejusa alias Jimmy Masiga Ogutu, Joshua Magezi Kyambadde alias Abdu Rahman, Jibril Kalyango alias Abu Aisha, Yusuf Siraje Nyanzi alias Jimmy Ssentamu and Shafik Kasujja are awaiting trial before the High Court over the same charges.
